Question

Criminal

X and her husband Y, have a toxic marriage. One day, X and Z, a hitman, waited for Y at a construction site. A and B, who were at the site and 4-meters away from X and Z, heard X say “Yariin mo na! Siguraduhin mong patay yan!” (Finish him off! Make sure he is dead!) When Y arrived at the site, Z took him to an unlighted area and fatally shot him in the head while X was acting as a lookout. They were later arrested and charged with Parricide after A and B reported the incident to the police. For her defense, X argued that she cannot be convicted as a principal because there was no formal, written, or express agreement between her and the hitman Z to execute the crime in that exact manner.

Is X liable for parricide even without an express agreement between her and Z to execute Y? (Bar 2026 Syllabus)
