Vic was hired as a second cook by ABC Shipping (ABC) on board a vessel. He underwent a medical examination and was declared fit to work. At sea, he noticed that the drinking water was salty and dirty. Later, he experienced sudden pains and nausea. He was later diagnosed with Costen Syndrome, urethritis and kidney stones. Upon repatriation, he did not report to the company designated physician claiming ABC refused to let him undergo a medical examination. He sought treatment from his personal doctor, and underwent surgery. After a doctor certified that he is no longer fit for maritime work, he filed a complaint for full disability compensation against ABC with the Labor Arbiter. ABC argued that he did not report for a post employment medical examination within three days from repatriation, and that his illnesses were not work-related.
